Data Processing and Use Terms

In short
You own your data. Your vehicles, drivers, readings and routes remain yours, and we will not sell them or hand them to anyone else.
We keep permanent rights to what we learn from it. We generate aggregated, de-identified statistics from customer data across our whole customer base such as how vehicle types behave and what normal fuel consumption looks like on certain routes. Those rights do not expire when you leave. This is how the system gets better at telling wear from theft, and it is a real grant. Section 3 sets out its limits.
1. Who owns what
Customer Data means everything your organisation puts into Bluestream or generates by using it: your vehicles and their details, your driver accounts, odometer and fuel readings, shifts, recorded positions, and the findings we produce from them.
Customer Data is and remains yours. We claim no ownership of it. We hold it to run the service for you, and on the terms below.
2. The licence you give us
To operate the service at all we need permission to store your data, move it between systems, run computations over it, and show it back to you. Formally: you grant Bluestream a worldwide, non-exclusive, royalty-free licence to host, copy, transmit, process, analyse, and display Customer Data for the purpose of providing, maintaining, securing and supporting the service.
That licence lasts as long as we hold the data. It is limited to running the service for you. It does not permit us to sell your data, publish it, or give any other customer access to it.
3. Derived data, and why we keep it
Separately from the above, we generate Derived Data: aggregated, statistical, and de-identified information produced by analysing Customer Data across many customers. Fuel consumption baselines for a class of vehicle. How much a given engine typically degrades per year. What a normal load-adjusted efficiency curve looks like on a particular kind of route.
You grant us a perpetual, irrevocable, worldwide, royalty-free and sublicensable licence to create Derived Data and to use it for any purpose, including improving our existing products, developing new ones, publishing benchmarks and research, and offering commercial products based on it. This licence survives the end of your subscription and the deletion of your account, and we are not required to remove Derived Data if you leave.
We are stating that plainly rather than burying it, so here are its limits:
- Derived Data must not identify you, meaning your organisation, your people, your vehicles, your customers, or your routes.
- It must not be reversible. If a statistic could be worked back to a single fleet, it is not Derived Data and this section does not cover it.
- It is not your raw data under another name. This section does not permit us to sell, licence, or disclose your actual readings, positions, or records. That is governed by section 2, which does not allow it.
- It does not extend to anyone else's rights. See section 4.
4. What you cannot grant on your drivers' behalf
Customer Data includes personal information about your drivers. We do ask for it, and the service does not work without it: their names, their working hours, and where the vehicle they were driving went during a shift.
If your drivers have rights over that information under the law where they work, then you cannot sign those rights away on their behalf. Nothing in these terms purports to do so, and any part of them that conflicts with such a right does not apply to the extent of the conflict.
You are responsible for telling your drivers that their location is recorded during shifts. The Driver Privacy Notice is written for that purpose and you are welcome to give it to them directly.
5. Confidentiality and security
We will not disclose Customer Data to third parties except to the providers we use to run the service, listed in our Privacy Policy, or where we are legally compelled to. If we are compelled, we will tell you unless we are prohibited from doing so.
Access is restricted by the database rather than by the interface, so one customer cannot reach another customer's records through any route. Administrative access by Bluestream staff is recorded in an append-only log.
6. If you leave
- You may export your data at any time while your account is open.
- On written request after closure we will delete Customer Data within 30 days, subject to backups expiring on their normal cycle.
- Derived Data already created is not deleted, for the reasons in section 3. By then it no longer identifies you.
- Audit logs are retained. They record what was done to an account, and a record that can be erased by the person who did it is not a record.
7. Changes to these terms
If we widen the rights in section 3, we will tell existing customers before it takes effect rather than relying on you noticing a changed date. Continuing to use the service after that point means you accept the change; if you would rather not, you may close your account and section 6 applies.
